Rugby Public School District #5,

Board of Education, held a special

board meeting Tuesday, April 20,

2021 at 5:00 PM in the Library at

Rugby High School.

Board members present were Dustin

Hager, Kris Blessum, Carlie John-

son, Shane Livedalen, and Brenda

Heilman.

Also present were Mike McNeff, Ja-

son Gullickson, Jared Blikre, and

Dawn Hauck. In addition, the follow-

Chairman Hager called the meeting

to order at 5:00 PM.

Motion by Johnson to approve the

agenda. Second by Heilman. All

voting yes, motion carried.

Sarah Massey with the ND Depart-

ment of Health presented regarding

contact tracing and how it

prevents/slows the spread of the

COVID-19 virus in schools and com-

munities. The ND DOH strongly

recommends continuing to contact

trace in the school. It was requested

of Massey if she knew how many

students ended up being positive

after being required to quarantine

from being a close contact at school.

That specific information is not

known.

Discussion was held on the length of

time it takes to contact trace and

whether taxpayer dollars should be

spent on contact tracing. The ND

DOH stated it takes roughly 15 min

per case to contact trace.

Sarah Massey noted that 99% of

schools in North Dakota are working

with the state or local health unit for

contact tracing.

With the increased number of

schools that are lessening the mask

requirement, there has been an in-

crease in the number of COVID-19

school cases in the state. Previous-

ly with the mask requirement,

schools did not show to be super

spreaders, but now that masks are

not being required, that could

change.

A legal opinion was obtained from

Pearce Durick Law Firm regarding

the legalities of contact tracing, but

no one from the law firm was avail-

able for the meeting. Amy Dekok,

the NDSBA attorney, provided infor-

mation which is not considered a le-

gal opinion. She noted that she is

not aware of any school in the state

that has stopped contact tracing.

The school may have a legal obliga-

tion to protect its employees.

McNeff noted that as much as he

does not like to contact trace, he

does not feel it’s in the best interests

of the students, staff, and communi-

ty to stop contact tracing.

It was noted that students masked

and unmasked are being grouped

separately in classrooms.

The board stated they would like to

involve the Health and Safety Com-

mittee in the discussions and also to

wait to hear from legal counsel

whether there is a liability or state

funding issue with not adhering to

the ND DOH recommendations.

The board heard information from

the audience including Erik Christen-

son, John Seil, Connie Harmel, Dal-

las Hager, Renee Kuntz and Renata

Warner. Sarah Massey responded

and stated that the 15% of schools

that no longer have the mask man-

date have a higher number of cases

and a higher number of quarantines.

Hager discussed being respectful of

others including children that might

have underlying issues and the unk-

nowns as a parent sending their

child to school.

Motion by Blessum to adjourn the

meeting. Second by Livedalen. All

voting yes, motion carried.

The meeting was adjourned at 6:23

PM.

Rugby Public School District #5,

Board of Education, held a regular

board meeting Tuesday, April 13,

2021 at 7:00 AM in the Library at

Rugby High School.

Board members present were Dustin

Hager, Kris Blessum, Carlie John-

son, Shane Livedalen, and Brenda

Heilman.

Also present were Mike McNeff,

Jared Blikre, Jason Gullickson, and

Dawn Hauck. In addition, the follow-

ing were in attendance: Sue Sitter

from the Pierce County Tribune, Kari

Hill, Dallas Hager, Sam Wentz, and

Karleen Blessum. Present by Zoom

were Angie Westphal, Becky Tofte,

Deb Goven, Kim Anderson, Levi Le-

mer, Shane Walker, Skye Cargo,

Christie Jaeger, Abby Goldade,

Kasey Okke, Julie Sjol, Dave

Schneibel, Dana Thoreson, Sadina

Bohl, Renee Kuntz, Connie, Nathan

Blessum, Renata Warner, and Levi

Heisler.

Chairman Hager called the meeting

to order at 7:00 AM.

Motion by Heilman to approve the

agenda. Second by Johnson. All

voting yes, motion carried.

Mr. Gullickson gave the elementary

report. Included in the report were

the following items: The midterm for

the last trimester is this Friday.

Registration for kindergarten for next

year is currently underway with 16

registered to date, but there are al-

ways more that register later. The

state assessment will be conducted

for grades 3-6 in English/Language

Arts and Math. The tests are about

6-7 hours each. MAP Testing will

also be conducted soon to assess

student growth during the year. Mrs.

Mattson will be putting together

spring concerts which will be posted

on Facebook for all grades.

Mr. Blikre gave the high school re-

port. Included in the report were the

following items: The ND State As-

sessments have started this week.

The senior Capstone night was last

Thursday. Twenty three students

presented. Region speech was held

last Saturday with nine students

qualifying for state. The regional

music competitions are coming up.

Competitions are held at each

school and judges will come to the

schools. The 8th graders will attend

a health careers camp at MSU Bot-

tineau. Prom will be held this Satur-

day. Spring activities have begun.

The annual FFA banquet will be

held on the 26th.

Dr. McNeff gave the District report.

Included in the report were the fol-

lowing items: A meeting was held

with Peace Garden Special Ed Ser-

vices. A Transportation Advisory

Committee meeting was held on

March 11th. The Hartley’s Bus con-

tract will be up at the end of the next

school year, so there will be some

negotiating. A design is being

worked on for the RHS Sports Com-

plex. The legislative session is not

over, but so far the funding formula

contains a 1% and 1% increase to

the per pupil payment for the next

biennium. ESSER money will be

used to address learning loss for ap-

proximately 30-40 students with a

summer school program. New

Teacher orientation will be held June

1-3. The technology committee met

to discuss upcoming technology

needs.

Mrs. Hauck reviewed the financial

report. Each fund was reviewed.

During this time of year, the General

Fund fluctuates as the timing of ex-

penditures varies. No transfer was

needed for the Food Service Fund

so far in April, which is the first

month where it has not been need-

ed. The sinking fund has some in-

vestments that need to change due

to the callable date of the fixed in-

come. The Bremer Wealth group

that is managing the money will

make the changes.

Items in the consent agenda were

considered. Motion by Blessum to

approve the Consent Agenda.

Second by Livedalen. Included in

the consent agenda were the March

9, 2021 Board Meeting Minutes, the

March 30, 2021 Special Board Meet-

ing Minutes, the March Board Bills,

the March Board bills detail, and the

March Financial Reports. All voting

yes, motion carried.

Dr. McNeff presented and discussed

information on the Strategic Plan,

Mill Levies, the focus areas defined

by the Citizens Committee, enroll-

ment, and COVID money the district

will receive in order to address facili-

ty needs at Ely Elementary. Jim

Perras with Consolidated Construc-

tion presented some information on

construction management. Dr.

McNeff requested that the board

give approval to start the process of

getting a construction management

firm in place and put together a

selection committee. Motion by

Johnson to put a bid out for a con-

struction management firm and form

a selection committee for starting

the process for looking at space

concerns at Ely. Second by Bles-

sum. All voting yes, motion carried.

Motion by Livedalen that the School

Board Election polling place be the

commons area of Rugby High

School. Second by Heilman. All

voting yes, motion carried.

Motion by Blessum to approve the

application for a cooperative to add

Leeds and Maddock to the Girls Golf

program in 2021-2022. Second by

Johnson. All voting yes, motion car-

ried.

The Bottineau/Rugby Hockey

Cooperative Agreement was dis-

cussed. The cooperative may have

to be renamed at some point as

there are many schools in the coop.

Costs are split between the schools

based on the number of participants.

Motion by Livedalen to continue

with the cooperative and approve

the amendments in the agreement.

Second by Heilman. All voting yes,

motion carried.

Motion by Heilman to recognize the

Rugby Education Association as the

representative organization for the

negotiating unit and to recognize

that the Education Association does

represent a majority of the teachers

within that unit. Second by Johnson.

All voting yes, motion carried.

by Blessum to approve the second

reading of the policies as written,

and that they become the official

policies of the district. Second by

Johnson. All voting yes, motion car-

ried.

The board discussed the continued

use of masks and face coverings at

school. The masks continue to keep

students in school by keeping them

from having to quarantine. A staff

survey was conducted with 25% of

the staff requesting that the masks

be worn for the remainder of the

school year. There are currently 30

days of school remaining. Thirty-six

percent of staff voted that masks

only be recommended, not required,

and 37% voted to require masks in

hallways, busses, and high traffic

areas only. The health of some em-

ployees can be a concern since

some people cannot get vaccinated.

Quarantining could become a prob-

lem without masks which would af-

fect academics, teacher prep time,

finding substitutes, etc. Mr. Blikre

noted that every change brings new

problems. Heilman noted that the

board has received several phone

calls, texts and emails from parents

about discontinuing the mask re-

quirement. Karleen Blessum spoke

and requested that the board consid-

er changing the mask requirement.

Motion by Heilman to change the

mask requirement to recommended

only, effective immediately. Second

by Johnson. Dr. McNeff noted that it

is difficult to implement things like

this immediately and requested until

the end of the week. Heilman with-

drew her motion.

Motion by Heilman to make masks

recommended only effective Friday,

April 16, 2021, at 3:30pm. Second

by Johnson. Further discussion was

held. A roll call vote was held:

Johnson – Yes, Heilman – Yes,

Blessum – Yes, Livedalen – No.

Motion carried.

Discussion was held on contact trac-

ing. The district would still work with

Sam Wentz at the Pierce County

Department of Health and would still

follow the DOH guidelines for

quarantining. A special meeting

may be needed to look at contract

tracing.

Johnson left the meeting at 8:56 AM.

Heilman noted that the change in

the mask requirement was a board

decision, not an administration deci-

sion.

The rest of the items on the agenda

were tabled.

The next regular board meeting is

scheduled for May 11, 2021.

The meeting was adjourned at 9:00

AM.

AT RISK SERVICES

RUGBY PUBLIC SCHOOLS

Rugby Public Schools requests

Statements of Qualifications for

Construction Management at Risk

Services for potential improvements

to existing facilities. This project is

subject to voter approval of a bond

referendum, and no construction

commitments will be made prior to

voter approval. The project scope

has not been finalized but will in-

clude addition and renovation to Ely

Elementary School.

Interested Construction Manage-

ment firms must submit a statement

of qualifications by 12:00 pm on

June 4, 2021, directed to:

Firms selected for an interview shall

be notified by the School District and

informed of a place and time for the

interview. The selection committee

will review the qualifications of each

firm on June 8, 2021 and will setup

interviews on June 9, 2021. The firm

will need to be available onsite or by

video conference for their interview.

The School District will choose the

firm at their regular board meeting

on June 14th at 7:00 am.

Rugby Public School requests the

following material for use in select-

ing the Construction Manager:

1. Procedure:

a. Eight (8) copies of 8 1 /2” x 11″

bound submittals, plus an electronic

submittal to Dawn Hauck, Business

Manager, at Dawn.Hauck@k12.nd.

2. Content of Submittal and Selec-

tion Criteria:

a. The company’s experience on

any similar projects.

a.i. Provide up to 5 similar projects.

a.ii. Include schedule, construction

cost, project Owner, and project

reference(s).

b. The company’s existing workload

and available capacity.

b.i. Include current and projected

projects.

c. The company’s key personnel ex-

perience on any similar projects.

c.i. Include brief resumes of per-

sonnel to be assigned to this project.

d. The company’s safety record.

e. The company’s familiarity with the

location of the public improvement.

f. The company’s fees for any ser-

vices including estimating and gui-

dance during the design process pri-

or to the referendum.

g. The company’s compliance with

state and federal law.

h. Any reasonable information the

selection committee deems neces-

sary.

3. All submitting firms shall provide a

statement indicating current in-

surance coverages and bonding

capacity.

4. All submitting firms shall explain

their approach to providing any

self-performance construction work.

Specifically, which trade(s) does the

company propose to provide, and

how will those costs be determined?

5. All submitting firms shall explain

their services related to supporting

the Architect and School District’s

work in facility planning and

pre-referendum services with a

focus on pre-referendum and

pre-construction phase services.

6. Form of Agreement:

a. AIA Document A133-2019, Stan-

dard Form of Agreement Between

Owner and Construction Manager

as Constructor

A selection committee consisting of

members of the Rugby Public

Schools Board of Education, Super-

intendent of Schools, Business

Manager, Architect, Engineer, and a

Contractor will short list firms, con-

duct the interview process, and

evaluate submittals, in accordance

with the Century Code of the State

of North Dakota.

Rugby Public Schools reserves the

right to reject any and all proposals

and to waive irregularities and infor-

malities therein and further reserves

the right to award the contract in the

best interests of the School District.
