NOTICE IS HEREBY GIVEN that by
virtue of a Judgment and Decree of
Foreclosure rendered against De-
fendants, Leon Schmaltz and Renee
Schmaltz and given by the District
Court in and for the County of Pi-
erce, in the State of North Dakota,
and entered and docketed in the Of-
fice of the Clerk of said Court on
July 9, 2020 in an action wherein
Peoples State Bank of Velva was
Plaintiff and Leon Schmaltz, Renee
Schmaltz, Duane P. Schmaltz, Betty
Schmaltz; any person in possession;
and all persons unknown claiming
any interest in or lien or encum-
brance upon the Pierce County real
estate described in the Complaint,
were Defendants, adjudging that
there is due and payable on the real
estate Mortgage described in
Plaintiff’s Complaint the sum of
$1,620,371.13 which Judgment and
Decree, among other things, direct-
ed the sale by me of the real estate
hereinafter described to satisfy in
part, with regard to the Pierce Coun-
ty property, the amount of the Judg-
ment with interest thereon and the
costs and expenses of such sale or
so much thereof as the proceeds of
the sale applicable thereto will satis-
fy, and by virtue of a Writ to me is-
sued out of the office of the Clerk
and under the seal of the Court,
directing me to sell the real property
pursuant to said Judgment and De-
cree, the undersigned Sheriff of Pi-
erce County, North Dakota, and the
person appointed by the Court to
make the sale, will sell the
hereinafter described real estate to
the highest bidder for cash at public
auction at the front door of the
Courthouse, 240 2nd St SE in the
City of Rugby and the County of Pi-
erce and the State of North Dakota,
on September 9, 2020, at the hour
of 11:15 o’clock in the a.m. of that
day to satisfy the amount declared
due and payable in said Judgment,
with regard to the Pierce County
property, with interests and costs
thereon and the costs and expenses
of such sale or so much thereof as
the proceeds of such sale applicable
thereto will satisfy. The interests of
Defendants, Leon Schmaltz and
Renee Schmaltz in the premises to
be sold pursuant to said Judgment
and Decree and said Writ and to this
Notice are located in Pierce County,
North Dakota, and are described in
the Judgment, Decree and Writ as

Schmaltz and Renee Schmaltz in

will be sold subject to a mortgage
held by Peoples State Bank of Velva
recorded with the Pierce County
Recorder as Document No. 198118.
If the sale is set aside for any rea-
son, the Purchaser at the sale shall
be entitled only to a return of the
deposit paid. The purchaser shall
have no further recourse against the
Mortgagor, the Mortgagee or the
Mortgagee’s attorney.

Wolford City Council Meeting
The Wolford City Council met on
Wednesday, August 5, 2020 at 7:00
p.m. Present were Mayor Wolf and
Council Members Slaubaugh and
Walsh. Deb read the June 23rd
minutes and Financial Statement.
Both were approved as read after a
motion by Slaubaugh and second by
Walsh. OLD BUSINESS: 1. The final
budget hearing will be Oct. 7. 2.
Spurge spraying was done by the
county. 3. Two loads of gravel were
delivered. NEW BUSINESS: 1. Pay-
ment of the monthly bills was ap-
proved after a motion by Walsch
and second by Slaubaugh (Waste
Management 755.44; Otter Tail
205.44; Bremer Bank 55.19; Pierce
County Tribune 23.68). 2. The gen-
eral liability renewal application for
insurance is due Aug. 14. Slau-
baugh motioned to adjourn w/Walsh
seconding. Motion carried. NEXT
