Felony cases heard

Judge John C. McClintock Jr., heard five felony cases in Northeast District Court in Rugby in recent weeks.

Donald J. Magnuson, 62, of Rugby, waived a preliminary hearing on a Class A felony charge of possession of a controlled substance with intent to deliver. Magnuson also is charged with a Class A misdemeanor count of providing false information to law enforcement. The next appearance on both charges is scheduled for Dec. 2.

Bradley Michael Geyen, 44, of Towner, pleaded guilty to a Class C felony charge of issuing a check upon a closed account. He was sentenced to five years in jail with three years suspended and credit for 235 days served. Upon release, Geyen will have five years supervised probation. He was ordered to pay $1,351.44 in restitution and additional court fees.

Wendy Jean Lozensky, 40, of New England, was sentenced to one year at the North Dakota Department of Corrections in Bismarck for revoking probation on a 2012 Class C felony conviction of possession of drug paraphernalia.

Paul John Dobson, 26, of Rugby, was sentenced to three years at NDDOC following a guilty plea in September to a Class C felony charge of corruption or solicitation of a minor. Dobson was credited for 258 days served and the remaining balance of the sentence was suspended. Dobson must register as a sex offender.

Selina Rosann Houle, 27, of Rugby had a bond hearing on a Class C felony charge of abuse or neglect of a minor child. An initial appearance date has not been set.

Other cases

Brady Tuchscherer, 21, of Rugby pleaded guilty to driving under the influence. Tuchscherer was sentenced to 30 days in jail with 28 suspended. He was ordered to pay $1,000 in fines and fees. Tuchscherer was arrested in the early morning hours of Nov. 1 after a one-vehicle accident. The 1995 Chevrolet pickup truck he was driving was found on its passenger side in front of 502 3rd Street SE at about 3 a.m. Tuchscherer did not suffer any serious injuries.
